Terms of Service

1. Acceptance of Terms

By accessing or using the Prospolabs API, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Prospolabs provides a business-to-business (B2B) face swap inference API. Our Service enables developers and businesses to integrate face swapping capabilities into their applications via our RESTful API. We offer realistic and cartoon face swap models accessible through authenticated API endpoints.

3. Account Registration

  • You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account.
  • You must notify us immediately at support@prospolabs.com if you suspect unauthorized access to your account.
  • You must be at least 18 years old to create an account.

4. API Usage

  • All API access requires a valid API key. You must not share your API key or allow unauthorized parties to use it.
  • Your account is subject to rate limits as specified in your account settings. Exceeding rate limits may result in throttled or rejected requests.
  • You agree not to circumvent, disable, or otherwise interfere with security, rate-limiting, or authentication features of the Service.
  • We reserve the right to suspend or throttle access if we detect usage patterns that threaten the stability or security of the Service.

5. Payment & Credits

  • The Service operates on a pay-as-you-go credit system. You purchase credits, and each API inference consumes credits based on published pricing.
  • New accounts receive a limited number of free trial inferences. After the free trial, a positive credit balance is required to make API requests.
  • All credit purchases are final and non-refundable, except where required by applicable law.
  • Volume discounts are applied automatically based on purchase amount as described on our pricing page.
  • We reserve the right to change pricing with 30 days' notice. Existing credit balances will not be affected by price changes.
  • Payments are processed by Razorpay. By making a purchase, you also agree to Razorpay' terms of service.

6. Acceptable Use Policy

You are responsible for all content processed through the Service using your account. You agree not to use the Service for any of the following prohibited activities:

6.1 Non-Consensual Use

  • Processing images of individuals without their knowledge or consent
  • Creating non-consensual intimate or sexual imagery
  • Using the Service for unauthorized impersonation

6.2 Deception & Fraud

  • Creating deepfakes intended to deceive, defraud, or spread misinformation
  • Identity theft or fraudulent impersonation of real individuals
  • Generating fake evidence or manipulated media for legal proceedings
  • Political disinformation or election manipulation

6.3 Harmful Content

  • Child sexual abuse material (CSAM) or any content involving minors in a sexual context
  • Content promoting violence, terrorism, or self-harm
  • Harassment, bullying, or defamation of individuals
  • Content that discriminates against protected groups

6.4 Surveillance & Privacy Violations

  • Using outputs for surveillance, tracking, or covert monitoring of individuals
  • Building biometric identification or recognition databases
  • Any use that violates applicable privacy or data protection laws

6.5 Illegal Activity

  • Any use that violates local, state, national, or international law
  • Use in jurisdictions where such technology is prohibited
  • Use in connection with weapons development, critical infrastructure interference, or export-controlled activities

Consent Requirement: You must ensure that you have obtained appropriate consent from all identifiable individuals whose faces are processed through the Service. You are solely responsible for compliance with all applicable consent and privacy laws.

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

7. Content & Data Ownership

  • Your Content: You retain all rights, title, and interest in the images you submit to the Service ("Input") and the results generated ("Output"). We claim no ownership over your Input or Output.
  • License Grant: You grant us a limited, non-exclusive license to process your Input solely for the purpose of generating the requested Output and delivering it to you. This license terminates upon completion of each API request.
  • Your Responsibility: You represent and warrant that you have all necessary rights, consents, and permissions to submit images for processing, including the consent of identifiable individuals depicted in the images.

8. AI Output Disclaimer

The Service uses artificial intelligence to generate face swap outputs. You acknowledge and agree that:

  • AI-generated outputs may not be perfect, accurate, or free from artifacts or errors.
  • We do not guarantee the quality, accuracy, or suitability of any Output for your specific use case.
  • Outputs are provided "as-is" without warranty of any kind.
  • You are solely responsible for reviewing Outputs before using them and for ensuring they comply with applicable laws and regulations.

9. Intellectual Property

The Service, including its software, API, documentation, website, branding, logos, and all associated intellectual property, is owned by Prospolabs and protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of any part of the Service beyond what is necessary for authorized API use.

10. Privacy & Data Processing

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including our handling of face and image data.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • In no event shall Prospolabs be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
  • Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you paid to us in the twelve (12) months preceding the claim.
  • We are not liable for any damages resulting from your misuse of the Service or violation of these Terms.

12. Indemnification

You agree to indemnify, defend, and hold harmless Prospolabs and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Content you submit to or generate through the Service
  • Your failure to obtain necessary consents from individuals depicted in processed images

13. Suspension & Termination

  • We may suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms, including the Acceptable Use Policy.
  • You may terminate your account at any time by contacting us. No refunds will be issued for remaining credits upon voluntary termination.
  • Upon termination, your right to access and use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.
  • Sections that by their nature should survive termination (including but not limited to Sections 6, 7, 8, 11, 12, and 14) will survive.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Prospolabs operates, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the governing jurisdiction.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date and, where appropriate, via email notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
